We are pleased to share that Duarte G. Henriques and Rita de Carvalho have contributed to the Austrian Yearbook on International Arbitration 2026 (AYIA), a leading international publication dedicated to developments and scholarship in the field of arbitration.
Their article, titled “Funding Counterclaims of Host States in ISDS: New Balances or New Risks?”, appears in the Investment Arbitration chapter of this year’s edition.
The contribution explores an emerging and relatively underexamined aspect of third-party funding in investor–state dispute settlement (ISDS): the potential financing of counterclaims brought by host States. The article examines whether such mechanisms could contribute to a more balanced procedural landscape or whether they may introduce new legal and systemic risks within the ISDS framework.
